Apple Standard EULA

Your download and use of Smolder from the Apple App Store is also governed by Apple's Standard EULA. You can read it here: Apple Standard Licensed Application End User License Agreement. If there is a conflict between these Terms and the Standard EULA as applied to you, the Standard EULA controls to the extent required by Apple.

Agreement

By installing or using Smolder, you agree to these Terms on behalf of yourself and anyone who uses the app on your device. If you do not agree, do not use the app.

Eligibility

Smolder is for adults 18 years or older only. You represent that you meet that requirement. Smolder is for consenting partners; you are responsible for how you use the app with another person.

License

Subject to these Terms and your compliance with them, GT Labs grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Smolder for your private, non-commercial enjoyment.

Acceptable use

You agree not to use Smolder to harass, harm, or non-consensually target anyone; to generate or store illegal content; or to violate applicable law or Apple's App Store Review Guidelines. The ground rules in the app mirror the following:

• You and any partner using Smolder must be 18 or older.
• Custom prompts you write live only on your device — keep them within the App Store rules: no minors, no illegal acts, no hate, no harassment.
• Photos you save to Memories must be of consenting adults. Don't capture or store images of anyone who hasn't agreed.
• Whisper messages between paired phones are private to the two of you. Treat your partner with respect and don't send anything they haven't asked for.
• If anything in the app — bundled or shared with you — feels off, report it from Settings → Legal and we'll review it.

Subscriptions & purchases

Paid features may be offered as auto-renewing subscriptions or one-time purchases processed by Apple. Pricing, renewal, cancellation, and refunds are governed by Apple's terms. To manage or cancel a subscription, use your Apple ID subscription settings. GT Labs does not control Apple's billing policies.

Smolder is for entertainment and relationship connection. It is not medical, therapeutic, or legal advice. If you have concerns about consent, safety, or health, consult a qualified professional.

Disclaimer of warranties

Smolder is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant uninterrupted or error-free operation.

Limitation of liability

To the maximum extent permitted by applicable law, GT Labs and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of Smolder. Our aggregate liability for any claim arising out of these Terms or Smolder will not exceed the greater of (a) the amount you paid us for Smolder in the twelve months before the claim or (b) USD $50.

Indemnity

You agree to defend and indemnify GT Labs against any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of Smolder, your violation of these Terms, or your violation of third-party rights.

Governing law

These Terms are governed by the laws of [your jurisdiction], excluding conflict-of-law rules, unless mandatory consumer protections in your country say otherwise. Courts in that jurisdiction have exclusive venue, subject to those mandatory protections.
